By booking a program, accessing our website, or engaging with our services in any capacity, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services.

2. Definitions

For the purposes of these Terms:

• "You" or "Guest" refers to any individual booking or participating in our programs
• "Services" refers to all wellness programs, activities, and related offerings
• "Program" refers to any thermal wellness journey offered by crestira

3. Eligibility and Age Requirements

To book and participate in our wellness programs, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete information during the booking process
• Disclose any health conditions relevant to thermal wellness activities

Participants under 18 may join programs only when accompanied by a parent or legal guardian who assumes full responsibility for their participation.

4. Booking and Reservations

4.1 Booking Process

Program bookings can be made through our website, by phone, or via email. All bookings are subject to availability and confirmation by crestira.

4.2 Booking Confirmation

A booking is confirmed only when you receive written confirmation from us via email. This confirmation will include program details, payment information, and relevant logistics.

4.3 Accuracy of Information

You are responsible for ensuring all information provided during booking is accurate, including contact details, dietary requirements, health considerations, and participant names. We are not liable for issues arising from inaccurate information.

5. Payment Terms

5.1 Pricing

All program prices are listed in Malaysian Ringgit (MYR) and include the components specified in the program description. Prices are subject to change without notice, but confirmed bookings will honor the price at the time of booking.

5.2 Payment Methods

We accept payment via bank transfer, credit card, and other methods as specified during booking. Payment processing is handled through secure third-party processors.

5.3 Payment Schedule

• A deposit of 50% is required at the time of booking
• The remaining balance is due 14 days prior to the program start date
• Failure to complete payment may result in booking cancellation without refund of deposit

6. Cancellation and Refund Policy

6.1 Cancellation by Guest

• More than 30 days before program start: Full refund minus 10% administrative fee
• 15-30 days before program start: 50% refund of total program cost
• Less than 15 days before program start: No refund
• No-show or early departure: No refund

6.2 Cancellation by crestira

We reserve the right to cancel programs due to insufficient enrollment, safety concerns, or circumstances beyond our control. In such cases, you will receive a full refund or the option to transfer to an alternative program date.

6.3 Force Majeure

Neither party is liable for failure to perform obligations due to events beyond reasonable control, including natural disasters, government actions, or public health emergencies. In such cases, we will work with you to reschedule or provide alternative arrangements.

7. Program Modifications

While we make every effort to deliver programs as described, we reserve the right to make reasonable modifications to:

• Specific activities or venues due to availability or safety considerations
• Accommodations or meal locations while maintaining equivalent quality
• Timing and sequencing of activities to optimize the experience
• Transportation arrangements as needed for logistics or safety

Significant changes will be communicated to you as soon as practicable. Such modifications do not constitute grounds for cancellation with refund unless the changes fundamentally alter the nature of the program.

8. Health and Safety

8.1 Health Disclosure

You must disclose any health conditions, medications, or physical limitations that could affect your participation in thermal wellness activities. This includes but is not limited to cardiovascular conditions, pregnancy, recent surgery, or heat sensitivity.

8.2 Medical Disclaimer

Our programs are designed for wellness and relaxation purposes, not as medical treatment. You should consult with your healthcare provider before participating in thermal wellness activities if you have any health concerns. crestira is not responsible for medical issues arising from participation.

8.3 Participant Responsibility

You are responsible for:

• Following safety guidelines provided by our staff
• Informing staff immediately if you experience discomfort during activities
• Maintaining appropriate insurance coverage for travel and activities
• Adhering to recommended soaking times and temperature protocols

9. Conduct and Behavior

All participants are expected to:

• Treat staff, guides, local partners, and fellow participants with respect
• Follow instructions from program guides and facility staff
• Respect local customs, cultural sites, and environmental protocols
• Refrain from behavior that disrupts the experience of others
• Comply with all applicable laws and regulations in Malaysia

We reserve the right to remove participants who engage in disruptive, dangerous, or illegal behavior without refund.

10. Intellectual Property

All content on our website and program materials, including text, images, logos, and design elements, are owned by crestira or used with permission. You may not:

• Reproduce, distribute, or create derivative works from our content without written permission
• Use our trademarks, logos, or branding in any manner
• Copy or adapt our itineraries, program designs, or business methods

11. Limitation of Liability

To the fullest extent permitted by Malaysian law:

• crestira is not liable for indirect, consequential, or punitive damages
• Our total liability for any claims is limited to the amount you paid for the program
• We are not responsible for services provided by third-party partners, including accommodations, transportation, or massage services, though we will assist in addressing issues
• We are not liable for loss or damage to personal belongings
• We are not responsible for delays, cancellations, or disruptions caused by weather, natural events, or circumstances beyond our control

12. Indemnification

You agree to indemnify and hold harmless crestira, its staff, guides, and partners from any claims, damages, or expenses arising from your participation in programs, including but not limited to personal injury, property damage, or violation of these terms.

13. Privacy and Data Protection

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Malaysia. Any disputes will be subject to the jurisdiction of Malaysian courts.
